AMATEUR ATHLETIC FULL WAIVER AND RELEASE OF LIABILITY AND FULL ASSUMPTIONS OF RISK AND INDEMNITY AGREEMENT

In consideration of being allowed to participate in the Inspire Dance Challenge Inc. "Inspire" with regards to athletic/sports program, related events, and activities, the undersigned individual acknowledges, understands, and agrees that:

1. This is to certify that I, as parent/guardian with legal responsibility for this participant (or as an Adult Dancer), do consent and agree to this AMATEUR ATHLETIC FULL WAIVER AND RELEASE OF LIABILITY AND FULL ASSUMPTION OF RISK AND INDEMNITY AGREEMENT and fully release and agree to fully and completely indemnify and hold harmless and indemnify the Releasees from any and all liabilities incident to the minor child’s involvement or participation in these programs,

2. The risk of physical or bodily injury from the activities involved in this program is significant, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious physical or bodily injury does exist; and,

3. AS PARENT/GUARDIAN (OR AS AN ADULT DANCER) I KNOWINGLY AND FREELY ACKNOWLEDGE ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM ANY NEGLIGENCE OF THE RELEASEES (as defined in paragraph 5 herein) OR OTHERS and assume full responsibility participation; and,

4. As Parent/Guardian (or as an Adult Dancer). If I observe any unusual significant hazard during my presence, I will remove any dancer that I have responsibility for, or myself, from the participation and bring such to the immediate attention of the nearest official, executive, instructor, or responsible employee; and,

5. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY FULLY RELEASE AND HOLD HARMLESS AND AGREE TO INDEMNIFY Inspire Dance Challenge Inc. , its employees, executives, officers, management, coaches, volunteers, fellow participants and Dancers, and Inspire Dance Challenge, their officers, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct any activities or events (hereinafter all collectively referred to as the “Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY, WHETHER CAUSED BY ANY NEGLIGENCE OF THE RELEASEES, OR OTHERWISE.

I HAVE READ THIS AMATEUR ATHLETIC FULL WAIVER AND RELEASE OF LIABILITY AND FULL ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

7. ENVIRONMENTAL HEALTH

Inspire will abide by the directives of the local Officer of Public Health with regard to any disease or environmental factor that may be identified as a public health risk. Participants may be required to be subject to screening, testing, social distancing, masking, or any other order deemed necessary to protect the public interest.

I AGREE IN SIGNING TO ABIDE BY ANY SUCH ORDER IN ATTENDING THE EVENT.

8. MULTIMEDIA RELEASE FOR FILM, TELEVISION, PRINT & SOCIAL MEDIA

Additionally, I hereby consent to the recording, capture, and republication of my image and likeness with the understanding that the event Inspire, its agents, employees, or representatives, sub contracted service providers will be undertaking the recording of the event for commercial reproduction for marketing and educational purposes. This signifies a general release to Inspire and its agents, including Competition Wizard (CAM) and affiliates. I consent to the royalty-free use of this media in perpetuity understanding that all ownership remains the copyrighted property of Competition Wizard & Inspire.

9. COMMUNICATIONS ACCEPTANCE

I Consent to Receive SMS Notifications, Alerts & Occasional Marketing Communication from company. Message frequency varies. You can reply STOP to unsubscribe at any time.

10. FORCE MAJEURE to be any shortcoming which cannot be attributed to

    Inspire, because it is not due to fault on its part and cannot be ascribed to it under the law, legal transaction or by convention including but not limited too war, civil unrest, financial crisis, public legal order, famine, flood, storm, power failure, fire or other "act of god" or unforeseen event preventing operation

    Without prejudice to the other rights to which it is entitled, Inspire shall in the case of force majeure

    1. have the right to suspend performance of the order of the Buyer, by notifying this in writing to the Buyer, without Inspire being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness. Full credit for a suspended event will be given towards any future Inspire production.

       c. Inspire reserves the right to postpone, adjust dates, reschedule and reprogram at its sole discretion.
